(Per : HONOURABLE MR.JUSTICE P.B.MAJMUDAR) Learned counsel Mr.Chirag Patel states that he has received instruction in writing to withdraw the appeal unconditionally as the appellant has accepted the judgment of the learned Single Judge. In view of the same, the appeal stands disposed of as withdrawn with clarification that withdrawal of this appeal will have no bearing so far as another appeal being Letters Patent Appeal No.263 of 2012 is concerned as the same has to be decided on its own merits. Learned counsel for the respondent states that he will not argue that since this appeal is withdrawn, subsequent appeal will not be entertained and that question is kept open.
In view of the above, Civil Application stands disposed of. Rule is discharged. Ad-interim relief granted earlier stands vacated.
