The petitioner was the fair price shop dealer of village panchayat, Laxmipur, District-Mainpuri. The petitioner ceased to operate the fair price shop dealership from 2003 due to illness of his son. The petitioner has changed his mind and wants to start his fair price shop dealership once again. In this regard, he submitted a representation on 18.01.2018.
Now the petitioner has approached this Court. The delay of almost 15 years has not been satisfactorily explained. The writ petition is liable to be dismissed on this ground alone. There is another matter of paramount public interest which is the interest of cardholders, who are the most deprived sections of the society. It is not up to the dealer to decide when to resume functioning as the fair price shop and when to cease. In case such rights are conferred on the dealer, it will disrupt the functioning of the public distribution system.
The writ petition is dismissed.
