Heard learned counsel for the petitioner and Shri Rajesh Srivastava, learned Standing Counsel for the State respondents.
In pith and substance, the petitioner is before this Court with the grievance that his application, which is pending consideration under Section 24 of the U.P. Revenue Code 2006 may be decided expeditiously. It has also been prayed that to command the respondents not to interfere in possession of petitioner over Plot no.1034Ka area .1450 hectare and 1037 Ka area 0.820 hectare situated at village Rithaura, Tehsil and District Bareilly.
Learned counsel for the respondents have not opposed the said prayer.
In view of the above, without expressing any opinion on the merits of the case and considering the facts and circumstances of the case, on consent, the writ petition is disposed of finally with a direction to the Sub Divisional Magistrate, Tehsil Sadar, District Bareilly to proceed in the matter and decide the aforesaid application so moved by the petitioner within six weeks from the date of production of a certified copy of this order before him, but certainly after according opportunity of hearing to all the stake holders in the matter.
