Heard learned counsel for the applicant, learned A.G.A. for State and perused the material available on record.
Accused-applicant, involved in Case Crime No.0435 of 2020, under Sections 419, 420 IPC & 66-D of Information Technology (Amendment) Act, 2008, Police Station Shivkuti, District Prayagraj, applied for anticipatory bail.
Learned counsel for the applicant submits that applicant is innocent and has been falsely implicated in the present case for the purpose of harassment. Applicant has committed no offence. It is further submitted that nothing has been deposited in the account of applicant. Except the present case no criminal history against the applicant. In case the applicant is granted anticipatory bail, he shall not misuse the liberty of bail and would co-operate with the investigation.
Learned A.G.A. has vehemently opposed the prayer for granting anticipatory bail but could not dispute the aforesaid facts and submitted that applicant made a telephonic call to the complainant and money has been debited from her account.
Having regard to the submissions made by learned Counsel for the parties, allegation levelled against the applicant, nature of accusation and without expressing any opinion on the merits of the case, I do not find a fit case to grant anticipatory bail.
Accordingly, the anticipatory bail application is hereby rejected.
