A preliminary objection has been raised by learned Standing Counsel with respect to maintainability of the writ petition on the ground that when the land was acquired in 2010 it stood in the name of the father of the petitioner who died in January, 2017, as such, the name of the petitioners on the basis of the will could not have been recorded because his father has lost rights in the land after acquisition. A further preliminary objection has been raised that the land acquisition notifications which have been challenged in this petition by the petitioners are already pending challenge in Civil Misc. Writ Petition No. 2623 of 2014 filed by the father of the petitioners.
When confronted with the aforesaid preliminary objections, learned counsel for the petitioners sought leave of the Court to permit withdrawal of the writ petition, with liberty to pursue the writ petition filed by the deceased father after being substituted.
Prayer is allowed.
Writ petition stands dismissed as withdrawn with the aforesaid liberty.
