ORDER:
In my opinion, this is a vexatious piece of litigation as the petitioner has unnecessarily indulged in avoidable litigation for a paltry sum of Rs.3997/- imposed as costs while setting aside the exparte decree.
Irrespective of the reasoning of the trial Court as well as the lower appellate Court, this Court is of the firm opinion that the petitioner ought not to have spent his energies and money in contesting the imposition of costs of Rs.3997/-, probably by incurring much more expenditure than the costs he was directed to pay. In this view of the matter, I do not find any reason to interfere with the orders of both the Courts below. Hence, the Civil Revision Petition is dismissed.
As a sequel to the dismissal of the Civil Revision Petition, CRPMP No.3728/2013 filed for interim relief is disposed of as infructuous.
