Mr.L.B.Dabhi, learned APP waives service of rule on behalf of respondent - State.
[2] The applicant is granted regular bail by this Court (Coram : HB Antani, J.) vide order dated 01.09.2008 in Criminal Misc. Application No.10201 of 2008 and this Court has imposed certain conditions. As per condition no.6(e), the applicant is required to mark his presence before the concerned Police Station till the trial is over. To delete the said condition, applicant has preferred this application.
[3] The order passed by this Court is in the year 2008. Till today, there is no untoward incident reported against the present applicant. The applicant has not breached any conditions imposed by this Court and has complied all the conditions. Charge sheet is also filed since long.
[4] Having heard learned advocates for the respective parties and considering above, condition no.6(e) in the order dated 01.09.2008 passed by this Court in Criminal Misc. Application No.10201 of 2008 is deleted. Rule is made absolute to the aforesaid extent. Present application is disposed of accordingly. Direct service is permitted.
