JUDGMENT / ORDER

1. Rule.
Mr.Manish J. Patel, learned advocate waives service of notice of Rule for respondents Nos.1 and 3 and Ms.Nisha M. Thakore, learned Assistant Government Pleader waives service of notice of Rule for respondents Nos.2, 4 and 5.
2. This application has been filed by the applicant (original petitioner) for amendment of the petition, as detailed in the memorandum of the application.
3. Heard Mr.Viral K. Shah, learned advocate for the applicant and Ms.Nisha M. Thakore, learned Assistant Government Pleader for respondents Nos.2, 4 and 5.
4. It is submitted by Mr.Viral K. Shah, learned advocate for the applicant that the amendment has become necessary in view of the subsequent events, that have occurred during the pendency of the petition,namely, order/communication dated 25.01.2012 passed by the Collector, whereby the request of the applicant to score-off the condition regarding embargo upon transfer and sale of the land in question has been turned down.
5. Having heard the learned counsel for the respective parties and in view of the nature of the amendment sought by the learned advocate for the applicant, the following order is passed :
The application is allowed. The applicant is permitted to make amendment in Special Civil Application No.17999/2011, as detailed in the memorandum of the application. The necessary amendment be carried out, within a period of one week from today. The learned counsel for the respondents may file their affidavits-in-reply to the amended petition, if necessary, by the next date of hearing.
Rule is made absolute, to the aforesaid extent.
