Heard learned counsel for the petitioner and learned Assistant Government Pleader for the respondents.
2. This writ petition was filed seeking quashing of FIR No.102 of 2006 on the file of the 3rd respondent police station which has a background of civil litigation.
3. The 3rd respondent filed a counter stating that the 4th respondent lodged a complaint on 14.08.2006 alleging that the petitioner criminally trespassed into her land, destroyed the fencing of the land and threatened to do away with her life. Basing on the said complaint, a case in Crime No.102 of 2006 under Sections 447, 427 and 506 read with 34 IPC was registered on 14.08.2006 and the matter was investigated. During the course of investigation, five witnesses were examined and their statements were recorded. The Investigating Officer arrested the petitioner on 14.08.2006 and he was later on released on bail. After completion of investigation, a charge sheet was also filed before the Hon’ble Court of I Metropolitan Magistrate, Vijayawada, and the same was taken on file as C.C.No.83 of 2007 and the case was pending trial.
4. In view of filing of the charge sheet, quashing of F.I.R. does not arise at this stage. Consequently, the writ petition is dismissed. Pending miscellaneous petitions, if any, shall stand dismissed in consequence. No costs.
