Respondent Petition under Section 438 of Cr.P.C., praying that in the circumstances stated in the petition and the grounds filed herein, the High Court may be pleased to grant anticipatory bail to the petitioner/Accused No. 2 in the event of his arrest in Crime No. 122 of 2013-14 on the file of the Prohibition and Excise Station, Yellareddypet, Karimnagar District and direct the release of the petitioner in such an event..
The petition coming on for hearing, upon perusing the petition and the Memo of grounds filed herein, and upon hearing the arguments of SRI K. K. MAHENDER REDDY, Advocate for the Petitioner and of the Public Prosecutor, for the Respondent, the Court made the following.
Order:-
The petitioner is A-2. He seeks for grant of anticipatory bail. He allegedly committed an offence under the provisions of the NDPS Act.
The petitioner is stated to be the President of Toddy Tappers Cooperative Society.
Learned counsel for the petitioner submitted that even according to the prosecution, nothing was recovered from the possession of A- 2.
In view of the fact that no contraband was seized from the possession of the petitioner-A2, I consider it appropriate to enlarge the petitioner on anticipatory bail.
Consequently, this Criminal Petition is allowed. The petitioner- A2 shall surrender before the Judicial First Class Magistrate, Siricilla, Karimnagar District, within two (2) weeks from today. On such surrender, the learned Judicial First Class Magistrate, Siricilla, Karimnagar District, shall enlarge the petitioner-A2 on bail on a bond of Rs.10,000/- (Rupees ten thousand only) with two sureties each in a likesum to his satisfaction.
