The petitioner complains willful disobedience and violation of the order of this Court dated 10.11.2008 in W.P.Nos.16953 and 20578 of 2008.
2. This Court through order dated 10.11.2008 after considering the nature of controversy between the parties and also the fact that the issue is pending before the Joint Collector, Karimnagar District, directed disposal of appeal filed by the petitioner. The substantial grievance is that while keeping the appeal pending, the contemptors herein have been disturbing the entries in the revenue records.
3. This Court ordered notice on 13.11.2013. The 1st respondent filed counter affidavit. Through counter, an attempt is made to justify the reasons for not moving in the matter within the time stipulated by this Court. Without getting into the correctness or otherwise of these reasons, it is suffice to record the statement of the 1st respondent that the appeals pending in file No.L/870/2009 and D/11670/2012 were posted for final hearing on 07.12.2013 and steps will be initiated to dispose of the appeals by the next date of hearing.
4. The learned counsel appearing for the petitioner submits that there is no further information from the petitioner whether the appeals are either disposed of or not. This Court has no reason to disbelieve the statement made in paragraph 6 of the counter affidavit. The petitioner failed to satisfy the Court that there exists contempt in the matter.
5. By placing on record the stand of 1st respondent, the present contempt case is closed. No order as to costs.
6. Miscellaneous Petitions, if any, filed in this contempt case shall stand closed.
