Chellam vs Masanam Servai

The learned counsel for the appellant would submit that the contesting respondent / first respondent died and this second appeal dismissed as abated against the first respondent on 18.08.2016 and the respondents 2 to 4 are only the formal parties. They remained exparte before the Courts below.

2. Since the contesting respondent died and the legal heirs of the deceased are not brought on record, this Second Appeal is dismissed for non-prosecution. No costs. Consequently, the connected Miscellaneous Petition is closed.
