(Per : HONOURABLE MR.JUSTICE JAYANT PATEL) Civil Application No.6435 of 2012 is filed by the applicant therein for condonation of delay of 836 days and Civil Application Nos.6437 to 6439 of 2012 are filed by the applicants therein for condonation of delay of 910 days in preferring the respective appeals against the judgment and award passed by the Reference Court, which is impugned in the first appeals.
We have heard Mr. A.V. Prajapati, learned counsel for the applicants-appellants and Ms. Moxa Thakkar, learned Asst. Government Pleader for the respondents. It is an admitted position that for challenging the very judgment and award of the Reference Court, State has preferred appeals being First Appeal No.376 of 2012 and allied matters and those appeals have been admitted. Similar application for condonation of delay was made by the other claimants of the same group being Civil Application No.2210 of 2012 and the said application for condonation of delay has been granted by this Court vide order dated 19.3.2012.
In view of the aforesaid peculiar circumstances and the facts and circumstances mentioned in the applications, we find that the delay deserves to be condoned and is hereby condoned. The applications are allowed. Rule is made absolute to the aforesaid extent, in each application.
