Heard learned counsel for the applicant, learned AGA and perused the record.
Learned counsel for the applicant submitted that due to village politics the complaint was got registered under pressure of the Pradhan. A civil suit was also filed. However, subsequently aggrieved person who has executed the sale deed filed a compromise application before the court below, hence in view of the above no offence is made out. However, the applicant is in jail since 10.2.2010.
In view of the above, without expressing opinion on merit, let the applicant Chaudhary Pasi be enlarged on bail on his furnishing a personal bond with two sureties each in the like amount to the satisfaction of the court concerned in Case Crime No.124 of 2009 under Section 328, 420, 467, 468 I.P.C. PS Siddharthnagar District Siddarthnagar.
