Chaudhary Ishrat Ali & Others vs Chief Secretary

High Court Of Judicature at Allahabad|20 December, 2018
|

JUDGMENT / ORDER

Court No. - 34
Case :- WRIT - A No. - 33092 of 2001 Petitioner :- Chaudhary Ishrat Ali & Others Respondent :- Chief Secretary,Education,Anubhag 12 Up Govt.,Lko. & Others Counsel for Petitioner :- S.K.Mishra
Hon'ble Sudhir Agarwal,J.
1. Called in revise. None appeared on behalf of petitioners.
2. By means of the present writ petition, petitioners have sought the following reliefs:
“(a) issue a writ, order or direction in the nature of certiorari quashing the impugned order dated 28.7.2001 passed by respondent no.2 and order dated 13.9.2001 passed by respondent no.3.
(b) issue a writ of mandamus directing the respondents to pay the petitioners salary continuously which they were getting prior to issuance of the order dated 13.9.2001 and 28.7.2001 and direct them not to disturb the seniority of the petitioners and not to recover the salary already paid to them.”
3. However, I have gone through the pleadings, grounds as also reliefs sought and find that petitioners are not able to make out a case so as to justify interference of this Court by granting reliefs, as prayed for.
4. Moreover, it appears that either the cause of action no more survives or that petitioners have lost interest in this matter or it has otherwise become infructuous and, probably for this reason, none is interested to have decided this matter on merits and that is why, counsel for petitioners is absent.
5. Dismissed. Interim order, if any, stands vacated.
Order Date :- 20.12.2018 AK
