Heard learned counsel for the petitioner; the learned A.G.A. for the respondents 1, 2 and 3; and perused the record.
The instant petition seeks quashing of the first information report dated 02.02.2021 registered as Case Crime No. 29 of 2021 at P.S. Hathras Gate, District- Hathras, under Sections 2/3 of U.P. Gangster & Anti Social Activities (Prevention) Act, 1986.
The allegation in the impugned first information report is that the petitioner has a gang, which indulges in anti-social activities punishable under the provision of Public Gambling Act. Three cases are stated to have been registered against the gang members including the petitioner under the provisions of Gambling Act.
As gambling is specified anti-social activity, the prayer to quash the impugned first information report cannot be accepted.
The petition is dismissed without prejudice to the right of the petitioner to apply for bail.
