Rule. Ms.Jirga Jhaveri, learned APP waives service of Rule on behalf of the respondent - State.
By way of present application, the applicant seeks deletion of condition No.7(iii) of the order dated 18.8.2010 passed in Criminal Miscellaneous Application No.9201 of 2010. Condition No.7(iii) reads as under:
"(iii) not leave the local limits of State of Gujarat without the prior permission of the concerned Sessions Judge;"
Heard Mr.J.M.Thakkar, learned counsel for the applicant and Ms.Jirga Jhaveri, learned Additional Public Prosecutor for respondent-State.
In view of averments made in the application, present application is allowed. The condition No.7(iii) of the order dated 18.8.2010 passed in Criminal Miscellaneous Application No.9201 of 2010 is hereby deleted. Rule is made absolute to the aforesaid extent. Direct service is permitted.
