JUDGMENT / ORDER

The petitioner was granted settlement of timings which was challenged by the party respondents herein, before the Tribunal. The Tribunal in a Revision filed by the party respondents, allowed the claim of the party respondents and directed the Secretary, RTA to revise the timings granted to the petitioner. The writ petition was filed in the year 2008 and on admission, there was an interim order granted staying the order of the Tribunal. In such circumstances, for all these years, if the petitioner had been running, it was in the settled timings as originally granted by the Secretary, RTA. For all practical purposes, the writ petition has become infructuous. If the party respondents have any grievance with respect to the timings, then the party WP(C).35797/08 2 respondents could definitely approach the appropriate authority in which circumstance, the petitioner will also be given a notice before any orders are passed. The writ petition disposed of, leaving the parties to suffer their respective costs.
