Heard Mr. Narendra Kumar Pandey, learned counsel for the petitioner and Mr. Bhanu Bhushan Jauhari, learned counsel for the respondent-Authority.
Having regard to prayers made in the writ petition, counsel for the respondent-Authority submits that if petitioner makes an application for refund of registration money or deposit made by him in terms of Clause V-3 of the Terms and Conditions For Allotment Of Multi Storeyed Flats (Annexure 1), the Chief Executive Officer, shall consider the same within a period of four weeks from the date of its presentation. In view thereof, counsel for the petitioner does not press this writ petition and seeks direction to consider the petitioner's application within time frame. Petition is accordingly disposed of. If the petitioner makes an application, as aforementioned, the Chief Executive Officer of the respondent-Authority shall consider the same within a period of four weeks from the date of its presentation. It is needless to mention that the petitioner shall be entitled for interest only in terms of the above clause.
