Heard learned counsel for the petitioner and learned Standing Counsel for the respondents.
Present petition has been filed with the following prayer:-
"It is therefore most respectfully prayed that this Hon'ble Court may graciously be pleased to direct the court below to decide the partition suit no. 127/2015 (New no. 51/2016) under section 176 U.P.Z.A. and L.R. Act pending in the court of Sub Divisional Magistrate Sadar District Prayagraj (Charan and others Vs. Jashwant Singh and others), within a short span of time. It is further prayed that this Hon'ble court may graciously be pleased to direct the court below i.e. Sub Divisional Magistrate sadar District Prayagraj to execute the order dated 16.4.2015 passed in aforesaid suit."
Learned standing counsel has no objection to the prayer made by learned counsel for the petitioner.
In view of the facts and circumstances of the case, with the consent of parties, without adverting on the merits of the case, the writ petition is disposed of directing the Sub Divisional Magistrate Sadar, Prayagraj- Respondent No. 2 to decide the aforesaid case strictly in accordance with law expeditiously without granting any unnecessary adjournments to either of the parties, if possible within nine months after submission of computer generated copy of this order and verifying the same from Official Website of Allahabad High Court.
