Heard learned counsel for the petitioner and perused the record.
Present petition has been filed for setting aside the order dated 29.3.2018 passed by the Additional Civil Judge (Senior Division), Court No. 3, Bulandshahr whereby the application i.e. paper no. 55C filed by the plaintiff petitioner in Original Suit No. 1002 of 2011 has been rejected.
In view of the fact that the case is fixed for final hearing and the application was made at the stage of final hearing, I am not inclined to entertain the present petition.
Accordingly, the present petition stands disposed of, however, with liberty to the petitioner to challenge the aforesaid order while challenging the final order, if the need so arises.
No order as to costs.
