Heard Ms. Mahima Maurya Kushwaha, learned counsel for the petitioner and Mr. A.K. Goyal, learned Additional Chief Standing Counsel for the respondent-State.
The only prayer made in the writ petition reads thus:
"I. Issue a writ, order or direction in the nature of mandamus commanding the respondent no. 2 to decide the objection of petitioner dated 20.09.2016 on the list of land published by Nagar Panchayat, Hasayan, District Hathras dated 08.09.2016."
It appears that the petitioner had raised objections, as were they invited vide advertisement dated 8.9.2016 (Annexure 10), issued in daily newspaper Dainik Jagran. According to the petitioner, though he raised written objections within the time stipulated, the concerned authority has not decided the same so far. Counsel appearing for the respondent-State submits that if the objections are still pending consideration, the concerned authority will decide the same within eight weeks. In the circumstances, we dispose of the writ petition by the following order:
Respondent No.2-Director, U.P. Local Body Department, Lucknow/competent officer, who is authorized to decide objections, as per the advertisement dated 8.9.2016 (Annexure 10), shall consider and decide the petitioner's objections (Annexure 11), if not decided so far, as expeditiously as possible and preferably within a period of eight weeks from the date of receipt of this order on merits in accordance with law. Petitioner is directed to produce a copy of this order alongwith copy of the writ petition and annexures before the concerned authority within a period of two weeks from today. It is made clear that if the objections are decided already, respondent No. 2 shall communicate its decision to the petitioner within a period of four weeks from the date of receipt of this order.
