HON’BLE SRI JUSTICE P.NAVEEN RAO WRIT PETITION No.24412 of 2014 ORDER:
The petitioner claims to be the owner and is in possession of lands to an extent of Ac. 2.63 cents in Survey No.37/1 and Ac.
3.29 cents in Survey No.37/2 of Boduvalasa Village, Sabbavaram Mandal, Visakhapatnam District. The petitioner claims to have purchased the said property through a registered Sale Deed bearing Doc. No.319 of 2007, dated 16.12.2006. The petitioner intended to dispose of the same and approached the Sub- Registrar, Sabbavaram Mandal, Visakhapatnam District (2nd respondent) requesting him to furnish the market value of the aforesaid land. Since oral request was not acceded to, a written representation was submitted on 09.08.2014 requesting to furnish the market value.

Learned counsel for the petitioner submits that on several occasions, the petitioner has visited the Office of the Sub- Registrar and as a last resort, submitted a written representation, but so far the market value particulars are not furnished to the petitioner and no reasons are assigned on the status of the land. Hence, this writ petition.
3. Having regard to the submissions made and without expressing any opinion on merits, the Writ Petition is disposed of directing the Sub-Registrar, Sabbavaram Mandal, Visakhapatnam District (2nd respondent) to consider the representation of the petitioner, dated 09.08.2014, and pass appropriate orders, as warranted by law, within a period of two (2) weeks from the date of receipt of a copy of this order. If the Sub-Registrar is of the opinion that the land claimed to be owned by the petitioner is not prohibited by any orders of the Government or statutory notification, he shall also consider the document as and when presented before him in accordance with the Registration Act, 1908, and the Indian Stamp Act, 1899, and process the same in accordance with the said provisions. There shall be no order as to costs. Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
