JUDGMENT / ORDER

(Per : HONOURABLE MR.JUSTICE JAYANT PATEL) Rule.
Mr.Pandya, learned APP waives notice of Rule.
The present application has been preferred by the applicant-convict for temporary bail on the ground that he wants to undertake the agricultural work of his land.
Considering the facts and circumstances and from the jail report, it appears that the furlough has to become due within a short time and the convict is in jail since 1 year and 10 months. The ground is not such where his presence can be said as indispensable since the other members of the family are already there to take care.
Under the circumstances, the discretion does not deserve to be exercised. Therefore, the application is not granted. Hence, dismissed. Rule discharged.
