1. This application has been filed by the applicant (original respondent No.3) with a prayer to fix an early date of hearing for Special Civil Application No.984/2009.
2. Heard Mr.Jal S. Unwala, learned advocate for the applicant and Mr.Devan Parikh, learned Senior Advocate with Mr.Nirav P. Shah, learned advocate for respondent No.1.
3. It is submitted by Mr.Jal S. Unwala, learned advocate for the applicant that the petition has been filed regarding an encroachment on the property of the applicant by the original petitioner, which is continuing from day to day and causing a lot of nuisance to the residents of the society and therefore, prayer for early hearing may be granted. As there is no objection to the said prayer on behalf of the respondents and for reasons stated in the application, the following order is passed :
Special Civil Application No.984/2009 be fixed for final hearing on 20.03.2012.
