Heard learned counsel for the petitioner and learned Standing Counsel for the State-respondents.
The writ petition has been filed seeking the following relief:-
"(I) Issue a writ order or direction in the nature of mandamus commanding the respondent no. 2 (Tehsildar Tehsil-Tamkuhiraj, District- Kushinagar) to consider and decide Mutation Case No. T201805440307790 (Jagarnath Vs. Kanta and others) under Section 34 of Land Revenue Act, 1901 which is pending since 06.09.2018, within short stipulated time to be fixed by this Hon'ble Court."
The petitioner is aggrieved as a restoration application filed by the opposite party against a mutation order passed in favour of the petitioner in the year 2013 has not been decided finally till date.
Under the circumstances, this writ petition is disposed of with a direction to the respondent no. 2/Tehsildar, Tehsil Tamkuhiraj, District Kushinagar to decide the restoration application as expeditiously as possible, preferably within a period of three months from the date a certified copy of this order is filed before him.
