This writ petition has been filed by the petitioners challenging the impugned F.I.R. dated 21.12.2015 registered as case crime no.0843 of 2015, under sections 398, 401 I.P.C., Police Station Raya, District Mathura.
From the perusal of the contents of the impugned F.I.R. it transpires that the minimum sentence prescribed under section 398 I.P.C. is rigorous imprisonment for not less than seven years. There is no description with regard to the maximum sentence under section 398 I.P.C. which connotes that maximum sentence can be awarded beyond seven years, hence this writ petition is not cognizable by this Bench.
