THIS APPEAL COMING ON FOR ORDERS, THIS DAY, THE COURT MADE THE FOLLOWING:-
ORDER Learned counsel for the appellant has filed a memo seeking permission of this Court to withdraw the appeal with liberty to file appeal before the District Court at Hassan.
2. Memo is taken on record. Accordingly, the appeal is dismissed as withdrawn reserving liberty to file an appeal before the District Court at Hassan.
Registry is directed to return the papers for the purpose of presentation before the proper Court.
Appellant is entitled for the benefit under Section 14 of the Limitation Act, if the appeal is presented within the prescribed time after returning of the papers.
