Heard learned counsel for the petitioner and perused the record.
By means of this writ petition under Article 227 of the Constitution, the petitioner has prayed for following relief as substantial one :-
"(ii). issue an appropriate direction under Article 227 of the Constitution of India, directing the Civil Judge (Senior Division), Azamgarh, to decide the Application 7C2 dated 5.10.2020 filed on the date 7.10.2020, by which plaintiff is seeking relief in the nature of temporary injunction against Respondents/ Defendants, filed in Original Suit bearing Case No. 136 of 2020 (Chandrapati Maurya v. Vivek and Others) within stipulated time as fixed by this Hon'ble Court, as the same is pending since 7.10.2020 and has not been decided till date.."
Learned counsel for the petitioner submits that defendants have appeared in the case.
Considering the overall facts and circumstances of the case, the petition is disposed of with a direction to the court concerned to consider and decide the decide Application 7C2 dated 5.10.2020 filed on the date 7.10.2020, by which plaintiff is seeking relief in the nature of temporary injunction against Respondents/ Defendants, filed in Original Suit bearing Case No. 136 of 2020 (Chandrapati Maurya v. Vivek and Others ) strictly in accordance with law and after recording satisfaction regarding service of summons and after giving full opportunity of hearing to the appearing parties, as expeditiously as possible preferably within a period of six weeks from the date of production of copy of this order.
