Heard learned counsel for the petitioner and learned Standing Counsel for respondents no.1 to 5.
The petitioner is Constable in U.P. Police. His services have been dispensed with by order dated 09.08.1998 under Rule 8(2) (b) of UP Police Officers of Subordinate Rank (Punishment & Appeal) Rules, 1991. The petitioner being aggrieved, preferred appeal before the respondent no.3-Deputy Inspector General of Police, Bareilly Circle, Bareilly.
Learned counsel for the petitioner submits that in the appeal an interim order was passed on 06.01.1999, copy of which is enclosed as Annexure 1 to the writ petition by which the appellate authority has stayed the dismissal order. However, more than twenty years has passed but the appeal of the petitioner has not been decided.
Learned Standing Counsel submits that no useful purpose would be served in keeping the writ petition pending, and an appropriate direction be issued to respondent no.3 to consider the grievance of the petitioner.
Considering the facts and circumstances of the case, without going into merits of the case and with the consent of the parties, the writ petition is disposed of with a direction to the the respondent no.3-Deputy Inspector General of Police, Bareilly Circle, Bareilly to decide the appeal of the petitioner pending before him expeditiously preferably within a period of four months from the date of production of copy of the order.
With the aforesaid observations, the writ petition is disposed off.
