JUDGMENT / ORDER

Sri.P.K.Muhammed, the learned counsel appearing for the 1st respondent (accused) submits that the 1st respondent (accused) has died and that therefore the appeal has abated in view of the provisions contained in Sec.394 of the Cr.P.C. This position is not disputed by Sri.B.S.Swathi Kumar, learned counsel appearing for the appellant. Accordingly, the Criminal Appeal challenging the acquittal stands dismissed as abated due to the death of the accused.
