Ashok Bhushan, Ag.CJ
Heard learned counsel for the petitioner and the learned Government Pleader.
2. By this writ petition, the petitioner has prayed for a direction to the 6th respondent to grant effective police protection to the life of the petitioner to enter and reside peacefully in his property referred in Exts.P1 and P2.
3. Petitioner's case is that he had already obtained an injunction order in O.S.No.602/2011, arising out of which, now O.P.(Civil) No.4073/2013 is pending before this Court. According to the petitioner, in the said suit, there was an order in his favour. It is submitted that in violation of the said order, the petitioner is not being permitted to reside in the said building.
4. We are of the view that since there are civil disputes pending between the parties and there being orders granting interim relief, it is appropriate for the petitioner to approach the said court for further orders, if any.
Hence this writ petition for police protection need not be entertained by this Court and accordingly the same is dismissed.
