Heard Sri Chandra Prakash Misra, learned counsel for the petitioner.
The present petition seeks a direction to the respondent no.1/Civil Judge (Junior Division) Kasya Kushinagar to decide the Original Suit No. 1507 of 2014 (Asgar Ali Vs. Kaushar Ali & others), which is said to be pending.
Learned counsel for the petitioner has referred to the order sheet of the case, a copy whereof has been filed as annexure 4 to the writ petition, to submit that the proceedings in the case are at an advanced stage and although various dates for evidence are being fixed but the case is being adjourned for some reason or the other. It is submitted that the delay in disposal of the suit is causing undue hardship to the petitioner.
In view of the aforementioned facts and circumstances, the present petition is disposed of with an observation that in case the petitioner appears before the court concerned and does not seek any unnecessary adjournment it is expected that the court below would make an endeavour to decide the aforesaid suit expeditiously in accordance with law provided there is no other legal impediment.
