HONOURABLE MR.JUSTICE A.J.DESAI Date : 24/12/2012 ORAL COMMON ORDER 1 Pursuant to the Order dated 21.12.2012, the respondents accused have appeared through their Lawyers and requested for time to file affidavit-in-reply. Mrs. Hansa B. Punani, learned APP, states on instructions from Mr. Vasantsinh, Head Constable of Naranpura Police Station, that all the investigation papers are lying with the learned Additional Sessions Judge, Court No.14, Ahmedabad, who has decided the applications filed by the present respondents accused for releasing them on anticipatory bail. As per the Condition No. (d) of the impugned Order date 18.12.2012, all the accused persons have remained present at Naranpura Police Station, today. She further states that she had talked with Mr. N.D. Solanki, PI, Naranpura Police Station about the same.
2 In absence of any investigation papers, it is not desirable to decide these applications only on the grounds mentioned in the applications and annexures produced by the complainant. The Investigating Agency and accused persons shall abide by the conditions imposed by the Sessions Court vide order dated 18.12.2012. Whatever investigation is carried out by the Agency here-in-after, would not prejudice the rights and contentions of either of the partie4s at the time of hearing of these applications.
3 The Investigating Agency shall keep all the investigation papers ready for the perusal of the Court on the next date of hearing.
