JUDGMENT / ORDER

The petitioner is the Principals of the college. He is seeking a direction for quashing of the orders passed by the District Inspector of Schools, Firozabad by which those students who were found absent at the time of inspection, have not been permitted to appear in the examination.
Learned counsel for the petitioner submitted that the impugned order has been passed without giving any opportunity to the petitioners. Those students, who have been prohibited to appear in the examination in respect thereof, their examination forms have been entertained. They all are the genuine students and legally entitled to appear in the examination.
Learned Standing Counsel submitted that that since long in the colleges malpractices are going on, namely, that the institution gets a registration of higher number of students and even of those who are not genuine and regular students and subsequently seek the admit cards for non-genuine students and whenever the inspections are made by the District Inspector of Schools they are found absent. He submitted that the Board is proposing to make a detailed inquiry in this regard and to verify that whether the students for whom the admit cards have been sought are the bonafide students or not.
Let the Board may make necessary inquiry in this regard and submit its report before this Court. Meanwhile, the Board is directed to permit the students whose examination forms have been entertained, provisionally, but their result may not be declared without the permission of the Court.
List in the first week of May, 2012.
Certified copy of this order be provided to learned counsel for the parties today on payment of usual charges.
