Heard learned counsel for the petitioner and learned Standing Counsel for the State-respondents.
Learned Standing Counsel has raised preliminary objection and submitted that present petition is premature as it has been filed only against the proposal dated 12.9.2021. He next submitted that said proposal would be verified by Tehsil Level Committee and thereafter on its report, Sub Divisional Magistrate (in short S.D.M.) shall pass order. Further, it is open for the petitioner to raise objection before the S.D.M., if any against the proposal. Therefore, at this stage, petition may be dismissed as premature.
Learned counsel for the petitioner opposed the submission, but could not dispute the procedure informed by learned Standing Counsel for grant of fair price shop.
Under such facts and circumstances, the writ petition is dismissed with liberty to petitioner to raise objection before S.D.M.-respondent no.2, if any. In case any such objection is filed, he shall consider the same while passing order on the proposal dated 12.9.2021.
