JUDGMENT / ORDER

(Per : HONOURABLE MR.JUSTICE RAVI R.TRIPATHI) Learned AGP Mr.Maulik Nanavati for respondent Nos.1, 2 and 3 sought permission to move Speaking to Minutes.
Permission was granted. The papers are received from the Registry.
2. From para-5 of the judgment, the following portion is deleted:-
"Such lapses are indicative of the fact that the authorized officer has failed to notice such discrepancy. Learned advocate Mr.Maulik Nanavati appearing for the authorized officer states before this Court that the authorized officer will abide by the directions of this Court and will rectify such mistakes after close scrutiny of the voters' list keeping in mind the by-laws of respective Seva Sahkari Mandalis - societies, and in the event any such discrepancies are noticed the number of persons permissible under the by-laws of the respective society only will be permitted to vote. Order accordingly.
The authorized officer, who is personally present in the Court expressed his regret for the said lapses. He tendered unconditional apology for the same and stated that a written apology will be filed in this regard in a day or two."
2.1 The aforesaid deleted para shall read as under:-

He tendered unconditional apology for the same and stated that a written apology will be filed in this regard in a day or two.
Taking into consideration the lapses which have come to the notice of this Court, it is deemed fit that the Director, Agricultural Marketing & Rural Finance, Gujarat State, shall undertake scrutiny of the names of the persons sent to the Authorized Officer for being included in the voters' list, keeping in ming the by-laws of the concerned Seva Sahakari Mandalies-societies. This exercise should be undertaken for all the societies and in the event, any error is noticed, the same shall be rectified by respondent No.1.
3. Speaking to Minutes is disposed of accordingly.
