Heard learned counsel for the petitioner and learned Standing Counsel.
This writ petition has been filed for issuance of mandamus commanding the respondent no.2-Consolidation Officer, Soraon, Allahabad to decide the restoration application no. 400/215/2016 under Section 9A (2) of U.P.C.H. Act (hereinafter referred to as Act) within stipulated time.
The contention of learned counsel for the petitioner is that the objection under Section 9A (2) of the Act decided vide order dated 26.9.2007 passed by Consolidation Officer. Against that order, a recall application was filed on 17.10.2016, which remain pending till date.
Under these circumstances, respondent no.2-Consolidation Officer, Soraon, Allahabad is directed to decide the restoration application no. 400/215/2016 under Section 9A (2) of the Act as expeditiously as possible preferably within a period of four months from the date of production of certified copy of this order.
Writ petition is, accordingly, disposed of.
