Heard learned counsel for the petitioner and the learned Standing Counsel appearing for the State- respondents.
The petitioner is working as Superintendent of Jail, District Deoria. He was transferred from Gorakhpur to Deoria on 28.5.2019. The petitioner was also directed to vacate the Government Accommodation.
It appears that when the petitioner did not vacate the aforesaid accommodation, a notice dated 13.3.2020 was issued to the petitioner to vacate the said accommodation at Gorakhpur and for the recovery of an amount of Rs.1,36,880/-as rent.
According to the learned counsel for the petitioner, he has vacated the aforesaid accommodation at Gorakhpur on 19.8.2020 and has handed over the possession to the competent authority. Thus, he submits that the respondents have illegally deducted the amount of Rs. 10000/- as penal rent from the salary of the petitioner since November, 2020.
Learned Standing Counsel appearing for the State- respondents submits that no useful purpose would be served in keeping the writ petition pending and the petitioner may approach the respondent no.3 by filing a representation against the deduction from his salary, which will be considered and decided by respondent no.3.
Considering the facts and circumstance of the case and without going into the merits of the case and with the consent of the learned counsel for the parties, the writ petition is disposed of with the liberty to the petitioner to file a fresh representation before the Senior Superintendent of Police, District Deoria-respondent no.3 raising all his grievances within a period of two weeks from today. In case, such a representation is made along with the copy of this order downloaded from the official website of the Allahabad High Court duly certified by the learned counsel for the petitioner, the respondent no.3 shall consider and decide the same by a reasoned and speaking order within a period of two months months thereafter.
With the aforesaid observations/directions, the writ petition stands finally disposed of.
