Heard learned counsel for the petitioner; the learned A.G.A. for the respondents 1 and 2; and perused the record.
The instant petition challenges a notice dated 05.02.2019 issued by the District Magistrate, Ghazipur calling upon an explanation from the petitioner as to why proceedings under the U.P. Control of Goondas Act, 1970 be not drawn against him.
As the impugned notice only calls for explanation, the petitioner has an opportunity to submit a reply to the notice.
In view of the above, we do not consider it appropriate to interfere with a mere notice. It is left open to the petitioner to take all possible legal as well as factual pleas that may be available to him in his reply to the notice.
The petition is disposed off.
