By means of the present petition, the petitioner has prayed for a mandamus to the District Magistrate Azamgarh to examine his complaint under the U.P. Panchayat Raj (Removal of Pradhan, Up-Pradhans & Members) Enquiry Rules, 1997.
From the perusal of the complaint, it transpires that the petitioner has complained regarding non-furnishing of the information.
In the considered opinion of the Court, such complaint cannot be said to be complaint within the meaning of U.P. Panchayat Raj (Removal of Pradhan, Up-Pradhans & Members) Enquiry Rules, 1997.
Accordingly, no direction can be issued. However, it is open for the petitioner to move appropriate application in accordance with the procedure prescribed under the U.P. Panchayat Raj (Removal of Pradhan, Up-Pradhans & Members) Enquiry Rules, 1997, if he is so advised.
The writ petition is dismissed. Consigned to record.
