The prayer made in the instant petition is for issuing direction to the court below to decide the application filed by the petitioner under Order 9 Rule 4 C.P.C. registered as Misc. Application No. 1 of 2006 (now bearing No. 16 of 2016), arising out of Original Suit No. 1051 of 1995 within a specified time frame.
Since the matter is pending before the court below for a considerable period, hence, the instant petition is disposed of with direction to the trial to decide the aforesaid miscellaneous application expeditiously without granting unnecessary adjournment to the parties.
