Heard learned counsel for the applicant.
The instant contempt petition has been for flouting the order dated 28.11.2017 passed in Application U/S 482 Cr.P.C. No. 39873 of 2017. The order reads thus:
"Heard the learned counsel for the applicant and the learned AGA and perused the record.
The only prayer made in the present application is for a direction to the court concerned to decide the Criminal Misc. Case No. 1157 of 2016 (State Vs. Gaya Prasad and Another) pending before C.J.M., Court No. 7, Deoria arising out of charge sheet submitted in case crime no. 1230 of 2015 under Sections 323, 504, 506, 452 I.P.C., P.S. Kotwali Deoria, District Deoria within a stipulated period.
Without expressing any opinion on the merits of the case, the learned trial court is directed to dispose of the aforesaid case expeditiously without granting any unnecessary adjournment to either of the parties, if there is no other legal impediment.
With the aforesaid observations the application under section 482 Cr.PC is disposed of."
On specific query, learned counsel for the applicant is unable to show that there is any wilful or deliberate disobedience on the part of the opposite party in complying the order of this Court.
In view thereof, petition is disposed of as withdrawn with liberty to the applicant to make an appropriate expedite application. In the event, such an application is filed, the same shall be decided in accordance with law.
