Heard Sri M.R. Khan, learned counsel for the petitioner and Sri A.K. Sand, learned A.G.A. for the State.
This writ petition has been filed with a prayer to quash the impugned F.I.R. dated 5.7.2018 registered as Case Crime No. 610 of 2018, under Section 376, 312 and 354 IPC & Section 7/8 Protection of Children from Sexual Offences Act, 2012, P.S. Kotwali, District Deoria.
Learned A.G.A. states that in compliance of this Court's order dated 19.7.2018, he has sought instructions from the S.P., Deoria and it is stated by him that the affidavits, which have been filed by the two daughters denying the allegations, appear to have been given by them under coercion of the petitioner. He further states that the mother of the petitioner as well as both the daughters have also deposed allegations against the petitioner in their statement recorded u/s 164/161 Cr.P.C. on 9.7.2018.
Considering the facts and circumstances and arguments advanced by the learned counsel for the parties, we are not inclined to interfere in the matter, hence, the present writ petition is, accordingly, rejected.
Interim order, if any, stands vacated.
