On 04.09.2017, this Court had directed respondent no. 2 to the writ proceeding to decide the application field by the applicants for grant of free hold rights within a period of three months after giving opportunity of hearing to them.
Counsel for the applicants points out that order of the Writ court was duly served upon the opposite party. Thereafter, a communication dated 03.01.2018 was sent by the Director, Defence Estate making request to ensure compliance of the order of the High Court but till date the application filed by the applicants has not been decided.
Having regard to the facts stated above, this Court before treating inaction on the part of opposite party as willful disobedience of the order of the Writ Court, grants her further time of eight weeks after receipt of certified copy of this order to decide the application filed by the applicants.
In the event, decision is yet not taken by the opposite party, it shall be open to the applicants to move to this Court again by way of a fresh contempt application.
The contempt application is disposed of accordingly.
