Heard Sri Shams Uz Zaman, learned counsel for the petitioner, Ms. Archana Singh, learned A.G.A. for the State and perused the impugned F.I.R. as well as material brought on record.
This petition has been filed by the petitioner with a prayer to quash the F.I.R. dated 11.2.2019 registered as case crime no. 81 of 2019 under section 13 (1) a, 13 (1) b, 13 (2) Prevention of Corruption Act, police station Sipari Bazar, District Jhansi.
Learned counsel for the petitioner submits that the petitioner has been scape goat in the present case as he has no power to provide electricity connection to any consumer. He is only working as skilled labour in the Company, namely, M/s Ashoka Enterprises at Jhansi which provide labour in the electricity department. The allegation levelled against him is absolutely false and frivolous, hence the same is liable to be quashed by this Court.
Learned A.G.A. opposed the prayer for quashing.
Considering the submissions advanced by learned counsel for the parties and nature of the allegations, it is directed that the petitioner shall not be arrested in above mentioned case, till the submission of the police report under section 173(2) Cr.P.C. but he shall co-operate with the investigation of the case.
With the above direction this petition is finally disposed of.
