Petitioner is seeking consideration of his claim for appointment to the post of teacher in Physical Education pursuant to advertisement published in the year 2011. The recruitment at that stage was being made in accordance with applicable provisions of recruitment i.e. Uttar Pradesh Subordinate Educational (Trained Graduate Grade) Service Rules, 1983.
During the pendency of the writ petition the recruitment process itself has been discontinued and a decision has now been taken to undertake the recruitment through the Public Service Commission. The decision taken by the State in amending the rules and providing for a different procedure for recruitment has already been sustained by this Court in Himanshu Shukla and another Vs. State of U.P. and others, reported in 2018(7) ADJ 426. The Division Bench has also affirmed the judgment with dismissal of special appeal. In that view of the matter no direction can be issued to consider petitioner's claim, since the process of recruitment stands discontinued.
Writ petition, accordingly, is dismissed.
