Heard learned counsel for the petitioner, learned A.G.A. and perused the impugned F.I.R. as well as material brought on record.
This petition has been filed by the petitioner with a prayer that suitable direction may be issued to respondent no.2 to transfer the case crime No. 506 of 2018 u/s. 395, 325, 323, 307, 504, 506 IPC, PS. Bhogaon, District Mainpuri to another circle in the District.
Learned counsel for the petitioner submits that the present petitioner who is the informant of the case has lodged the FIR for the aforesaid offences and during the course of investigation, the police has dropped some of the offences, hence, the investigation be transferred to another circle.
Learned A.G.A. opposed the prayer and submits that the investigation is in progress and there appears to be no ground for transferring the investigation to another circle.
In view of the above, the prayer to transfer the investigation to another circle is rejected.
However, we direct the Investigating Officer of the present case to conclude the investigation of the present case and submit a police report before the Magistrate concerned expeditiously preferably within a period of two months from the date of production of a certified copy of this order in accordance with law.
The S.P. Mainpuri shall ensure compliance of the present order within the aforesaid period.
With the aforesaid order, the present petition stands disposed of.
