Heard learned counsel for the petitioners and Sri Vikram Bahadur Yadav learned Standing Counsel.
The petitioners are Assistant Sub Inspectors (Ministerial). They claim parity with the pay scale as provided to Head Constable (Radio). This prayer is addressed in light of the communication appended at page-20 of the paperbook.
At the very outset it is relevant to note that the said communication is neither a Government Order nor a final decision of the State Government according parity between Assistant Sub Inspectors (Ministerial) and Head Constable (Radio). The said communication only records a perceived parity between the posts of Assistant Sub Inspector (Ministerial) and Head Operator (Ministerial). In the absence of any material which may have even prima facie evidenced similarity between the two posts, the Court finds no ground to issue the writs as prayed for.
Additionally the Court notes that the pay band even otherwise has been enumerated in the Uttar Pradesh Police Ministerial Accounts and Confidential Assistants Cadres Service Rules 2015 and learned counsel has been unable to establish that both the posts fall in the same cadre.
The petition lacks merit and is dismissed.
