Heard learned counsel for the parties.
The petitioners, who are owner and in possession of plot nos. 640/1 measuring 0.227 Hectare, 640/2 measuring 0.012 Hectare and 650 measuring 0.253 Hectare, on laying down road on the presumption, have preferred the instant writ petition with the prayer to direct the opposite parties not to construct and lay down road on any part of the land of the petitioners on which they are tenure holders.
Notices were issued.
Counter affidavit was filed on behalf of opposite parties no.1 to 3, in which it has been stated that no part of the petitioners' land either being subjected to any proceedings nor the road has been laid down, to which no rejoinder affidavit has been filed.
In view of the above, the writ petition is dismissed.
